Decisions need to be made so that the other courts don"t overturn it. Best place for this model is the supreme court. Less constrained by precedent, can ignore the past. Also, there is usually precedent on both sides at this level. There are more hard cases at this level. Less preferences involved, more straight facts to rule on. Sc has a discretionary docket, can pick which cases to rule on. No higher court, so no control over it. Attitudinal model built on evidence from the supreme court. At the lowest level, there is no intra-court battle. At the intermediate appellate court, this does matter. However, they do plan on opinions of higher courts. 3-judge panel, each judge needs to plan what the other judges will do. Also, possibility of en banc review (review from entire circuit) The decision to review is an ideological issue. Essentially, two levels of review available at this level.
