Many scholars and policymakers have questioned death penalty application. Death penalty supporters asser it is applied fairly & checks exist. U. s. supreme court has never ruled the death penalty is cruel and unusual . Cases like furman v. georgia have had serious impact on handling of capital punishment. Furman, 26 year old african american male broke into someone"s home when he was confronted by the homeowner. He attempted to escape, dropping his gun in the process, the gun went off killing the homeowner.
