5th amendment prohibits the federal government from depriving individuals of life, liberty, or property without due process of law. 14th amendment prohibits state governments from violating an individual"s right to due process and equal protection. Courts have interpreted these provisions to prohibit employment discrimination by federal, state, and local governments. Civil rights of 1866 was meant to provide freed slaves with same rights as white citizens. Has been interpreted to prohibit racial discrimination in both private and public employment (except it doesn"t apply to the federal government) Under the equal pay act, a worker may not be paid at a lesser rate than employees of the opposite sex for equal work. Equal work means tasks that require equal skill, effort, and responsibility under similar working conditions. It is illegal for employers with 15 or more employees to discriminate on the basis of race, color, religion, sex, or national origin under title vii of the civil rights act of 1964.
