The state of nature is a state of war of all against all. This is as individuals, motivated by the drive for "felicity", will inevitably come into conflict over scarce goods, and, in the absence of a sovereign, this conflict will escalate into full-scale war. The state of nature is governed by a moral law that could be enforced by every individual. We are initially in a condition of abundance, not scarcity, and with an implicit assumption that people will often be directly motivated to follow the moral law. This only serves to delay the onset of severe conflict, and will not avoid it forever. If these are enforced, however, does this not become a fledgling state. A person"s moral and/or political obligations are dependent upon a contract or agreement among them to form the society in which they live. The social contract: tacit consent - voting is a way of tacitly consenting.
