LAWS 1000 Lecture Notes - War Measures Act
Document Summary
Industrialization, urbanization have forced canadians to rely on law to de ne our rights/ obligations -> turn increasingly to formal adjudication to settle disputes. This can be seen in family law and federalism; spouses resort to court to settle matters. Too many canadians run straight to the court to handle differences, rather than a more informal environment. Canada s expansion of legal profession and legal aid programs have made the option of taking personal cases to court more available. Need for court much depends on attractiveness of judicial institutions and availability of alternatives. Very little of increased need for adjudicative services is due to the expansion of the courts. more has been taken care of through private arbitrations and administrative tribunals. Administrative improvements in court may reverse this trend by reducing some of the delay which used to drive business away from courts. Public law explosion -constitutional rights that can be claimed by the individual, nally settled in court.
