-Question 2 consists of five short problem scenario questions - (a- privacy & trespass), (b- breach
of confidence), ©- freedom of information, (d) contempt of court and (e)- open justice ( each worth
4 marks (revision questions, problem questions, discussion questions)
-Question 3 is an essay question- consider whether Australian law provides sufficient protection for
free speech or whether we need greater protection for free speech in this country. Give some
specific examples from at least 2 areas or 2 topics of law that we have covered throughout this
semester.
Defamation?
Speech may take a number of forms including:
-speech with factual content, that is information;
-speech with normative or moral/ethical content (including political discussion and opinions)
-speech with expressive content (especially artistic works or acts of self-expression)
Within QLD, the legislation pertaining to defamation law is the Defamation Act 2005 (Qld), brought
about by the uniform Defamation Acts.
The objects of the Act include:
-Ensuring the law of defamation does not place unreasonable limits on freedom of expression,
publication and discussion on public interest matters and matters of importance;
-providing effective and fair remedies to persons harmed;
-to promote speedy and non-litigious methods of dispute resolution.
Freedom of the press-
differences that flow between Australia's media laws and America's media laws as a result of some
of those constitutional differences. United states has the first amendment, Australia we have a
much more limited concept of the implied freedom of political communication
Considering some of the law that applies to court reporting
Privacy
-Is there a common law tort of privacy in Australia?
Common law of privacy
-Just a reminder that common law = law made by the courts.
-Initially, the protection of privacy was limited to information privacy as under the Privacy Act, and
also under other causes of action such as trespass, nusiance, criminal law, defamation;
