Wk1: Primary and Secondary Sources of Law
● Primary sources of law: the law ie anything from lawmakers (give us direct info)
○ Judges’ decisions
■ Law report: a collection/volume of judgements, collected by the
publisher - important for the doctrine of precedent (primary source)
● Publishers decide which reports are of interest for precedent
● Reported versions of cases have headnotes
○ Regulations
○ The Constitution
○ Legislation
○ International instruments
● Secondary sources of law: anything about the law (give us indirect info)
○ Academic articles, incl judges writing extrajudicially
Wk2: Case Citations
● Medium neutral version: just contain basic information about the case eg which court,
has square brackets (publication year essential to finding the decision)
● Reported version: published by a certain publisher eg CCH
○ Authorised law reports: have been authorised by court as the preferred law
report series for that court, take precedence over others, use when available!
■ CLR (Commonwealth Law Report for High Court of Australia)
■ FCR (Federal Court Report for Federal Court of Australia)
■ NSWLR (NSW Law Report for Supreme Court of NSW)
■ AC (for House of Lords/Supreme Court in UK)
