Goal of criminal law - create a system that encourages or discourages certain behavior, putting restraints on certain behaviors, molding our society. Factors that make law different from other institutions. Law is the only institution of social control backed by the organized forces of society. No other institution covers everyone in a given polity. You can"t opt out of the law or get out of it. Only institution that can take 3 things from you: your property, liberty, life. We change laws based on how we want social behavior to take place. Ex) drug laws - will be different in ga than other states. This is a criminal case - always the gov"t vs the defendant. When you break the law (criminal cases) the victim party is the society because you broke the society"s laws. Even if you are the one who is mugged, criminal law still sees the society as being the offended.
