Chapter 8: the courtroom work group and the criminal trial. Federal = nominated by president and confirmed by senate. State = election or political appointment: criticized because allows politics to enter judicial arena, missouri plan combines election and appointment. Some require training sessions: hold law degree, be licensed attorney, member of bar association, national judicial court (njc) specialized training. Some states lower courts (justice of peace, local magistrates, district ) don"t require education or professional requirements. Prosecutors are usually allowed to make sentencing recommendations. Some forms of abuse are unconscious: leniency toward female defendants and discrimination against minorities. The prosecutor"s professional responsibility: must follow the aba model rules of professional conduct. Private attorneys: either have own legal practices or work for law firms that they are partners or employees of. Fees can be high typically, charged for hours spent on case plus time spent in court.
