Can"t sue the parents because they"re not liable. A child is held to the standard of care of a child of similar age, intelligence and experience. Treat a 5 year old, as an average 5 year old. Treat a 10 year old, as an average 10 year old. Up to the age of 7, a child can do no wrong. We think that the child is not negligent, however they can be negligent if it can be proven.
