Telecommunications act protects internet operators from being sued for libelous statements in a message written by a 3 party element of fault and question of whether you were at fault a letter to the editor. Fault: different types of plaintiffs have to prove dif levels of fault: o o. 2- negligence: person you are suing didn"t do something a normal person would do. 3- strict liability: (ny times v. sullivan), plane crashes than the manufacturer or company is usually held responsible o: for private persons, ny times actual malice for punitive damages and negligence in most states for general damages. Person purposefully tries to influence outcome of public controversy, agreeing to interviews, assumes a prominent position in its outcome against his will; has to prove. Reporter"s privilege: comments made in court proceedings, official documents, judicial proceedings, court documents, that are accurate and fair, attributed with no ill will.
