Record suspension happens after one year of the sentence. Young offender if convicted of a summary conficted it will be removed three years after the sentence. Young offenders convicted of an indictable offence will have to wait 15 years for the record suspension will kick in. The judge decides how a defendant will be penalized for committing a criminal offence. There are often differences of opinion as to what appropriate sentences are. Separate the offender from society: when the offender is sentenced to serve time in custody (jail) the community is protected from the offender for that period of time. In the criminal code each offence is classified as either a summary conviction, hybrid (dual procedure) or an indictable offence. These classifications are used by judges to determine appropriate sentences: summary. Maximum of six months in jail and fine: hybrid or indictable.
