Crimes vs. torts crime: public wrong, an offence committed against the public interest. Only need to show that the defendant"s actions, whether they were intentional or not, caused harm. No book of status that direct how the law of torts should be administered. As societies develop, new types of disputes arise. In all provinces and territories other than quebec, a tort law system is derived directly from the english common law system. Tort law actions have been used to address wrong doings of government of cials (ex. police), health professionals, politicians, corporations, manufacturers, etc. Usually the threat of publicity arising from the tort action causes corporations and the government to address identi ed problems. Six functions: compensation, tort law serves to compensate the injured party, usually in the form of money, special damages are losses that are speci c and easily calculated (ex. car damages) Suf cient to show that the wrongdoer intended some form of harm.
