Assess the modern presidency from a democratic perspective: key terms. Imperial presidency: the origin and evolution of the presidency. What has changed domestically and abroad that has required the role of the presidency to change too: the multiple roles of the modern president. An executive council that acts as the presidency rather than one person. Founding (checks and balances within the executive?) but then specifically rejected. The president"s right to withhold info from congress under certain circs. Exec needs to be able to have its own deliberations. The constitution is silent about executive privilege, but even the early president"s claimed this, esp in foreign affairs/defense/national security. Us v nixon (1974): can"t be used to impede criminal investigations. Executive orders: fairly modern development which has allowed the president to intrude into administration vs congress. Has the force of law until it is retracted, congress nullifies it, or a court rules it conflicts with the constitution or a federal law.
