LAW 110 Chapter Notes - Chapter PJ Rule Explanation: General Jurisdiction, Minimum Contacts
Document Summary
Pj can be established over a party in the form of general jurisdiction or specific jurisdiction. General jurisdiction can be established over and individual if he is domiciled in that state or if he is served with process in that state, known as tag (transient) jurisdiction (burnham). General jurisdiction gives that state power over the defendant for any claim. Specific jurisdiction gives the state power over the defendant only over claims arising out of the d"s contact with that state, and only to the extent of that contact. In order for a state to have specific jurisdiction over a d, the d must have minimum contacts with the forum state (international shoe), unless they otherwise consent to pj in that forum. Further, courts consider the quality and nature of the contacts. Sufficient minimum contacts must show proof that the d purposefully availed himself to the forum state (hanson).
