An instrumentality of a crime refers to a tool used during the commission of an unlawful act (gun) A seizure usually occurs during the course of a search. It is the taking of a discovered item into custody. Police oicers can search people, places, and things and can also seize persons, place, and things. The laws of search and seizure, which are derived from interpretaions of the 4th amendment to the consituion, establish the rules by which oicers must play the crime game.
