Based on the belief that all gov"t officers pledge to uphold and follow the constitution. Set the precedent for future court decisions by ruling that warrantless seizure of property from a private home is a violation of fourth amendment. Police and the courts: due process (fifth amendment): protects citizens against the abuse of government authority and the 14th amendment addresses equal protection under the law. Due process clause is broadly defined as protections against unclear laws, and application of the bill of rights to include the states : procedural due process is applicable to arrest and trial procedures: places limits on police powers. Guarantees against double jeopardy, insures proper arrest procedures, the right to remain silent, right to not be subject to unreasonable search and seizures, and the right to an attorney.
