PSC 210 Chapter Notes - Chapter 3: Mootness, Political Question, Ripeness
Document Summary
Opinion issued by a court or a commission like an election commission that does not have the effect of adjudicating a specific legal case, but merely advises on the constitutionality or interpretation of a law. Both parties bringing a lawsuit but want the same outcome. By the time the lawsuit gets to the court, the issue has been settled. Woman wanted abortion but by the time the court was ready she had already had her baby. Even though the pregnancy is moot, there is still the possibility of her getting pregnant again and face the exact same issue. Even if the case is moot, it"s too important to dismiss. Hasn"t evolved enough through the lower courts. Look for cases ruled on multiple times to give lower courts time to think on the issue. Comes down to a question of whether or not the court system is an appropriate forum in which to hear the case.
