Interstate commerce commission was the first administrative agency, regulating freight and passenger transportation over the rails. Had the flexibility to deal with problems like regulating, investigating and punishing. Agencies are in the federal, state, and local level: executive and independent agencies. Some are part of the executive branch and others are independent. President has control of executive agencies because they can fire the agency head at any time and the agency will seldom diverge far from the president"s preferred policies. Ex: irs, fbi, food and drug admin. President has no removal power on independent agencies. Ex: fcc, federal communications commission: congress created a federal agency by enabling legislation. They describe the problems that congress believes need regulation, establishes an agency to do it and defines the agency"s powers. Power of agencies: they make rules, investigate and adjudicate, rulemaking. Agency attempts to establish fair and uniform behavior for all businesses in the area.
