Document Summary

If attorney requested, confer and can have attorney present during interrogation. Especially innocents and juveniles (prefrontal cortex hasn"t fully developed yet for juveniles, don"t have developed decision making) Miranda rights can be waived only voluntarily, knowingly and intelligently before the interrogation can begin. Defendant must be able to read and understand the miranda rights. May be limited for the mentally ill, cognitive ability and youth. Juries are more likely to convict if there is a confession. 25% of the time false convictions are based on false confessions. When the interrogator uses the accusatory method it can pressure innocent people to confess. Tell them they did the bad thing and wait for them to confess to that, they will think they did it. eg. say they will be punished no matter what they say. Told him that he could either go to adult prison if he didn"t confess or rehabilitation if confessed. Evidence was eventually found that proved him innocent.
