Document Summary
At least 2 of the academic sources need to argue for litigation and 2 that argue for adr. Part of the instructions will be signing a confidentiality paper. Alternative dispute resolutions (last week reconciliation was discussed) Parties collaborating together trying to settle a dispute. Management and union trying to collaboratively reach a agreement. Mediation it is often thought of, said to be an assistant negotiation process or another/similar way to define it is as an extension of a negotiating process. There has been some sort of conflict dispute and negotiations going on to try and resolve it but it has not been successful so an extension of the negotiating process has been sent in. A third party, nonpartisan, has been brought in to assist in the negotiating process to try and resolve the dispute with the aid of assistance. As in conciliation the third party brought in has no power/jurisdiction to impose a settlement.
