Critical race theory- came out of legal scholarship developed in us, challenges dominant ideas that we all have about the law (promoting fairness/equality) Came out of events happening at harvard law (dr. derrick bell) only black member on faculty at the time. Concerned that he was leaving for another school. Understand creation and maintenance of white superiority and subordination of people of color. How race is structured and structured by ideas/legal doctrines such as fairness, equality and equal protection under the law (seemingly neutral legal doctrines) *race neutral doctrines are not neutral (constructed according to white experiences) *they want to change the relationship between race, racism and the law. First significant acknowledgement by supreme court that race does matter in terms of interactions with the law. No objectivity or neutrality within academic knowledge and/or legal sphere.
