Sentence of less than 6 months in prison. Defendant does not have a right to a trial by jury. Include theft, obtaining money or property by false pretences, and failure to comply with a probation order. Must be tried by judge and jury. Accused can choose whether the trial proceeds by judge and jury or judge alone. Offences not listed in s. 553 or s. 469 - such as robbery, arson, and sexual assault with a weapon. If proceed by summary - maximum sentence is 6 months, or 18 months in some cases such as sexual assault. If proceed by indictment - maximum sentence is 5 years or more. Juries act - provincial and territorial legislation that outlines the eligibility criteria for jury service and how prospective jurors must be selected. A court order that states a time and place to go for jury duty.
