Andrea gisbrecht case: found guilty on 6 charges with intent to conceal babies bodies, the defense argued she wasn"t disposing of them but saving them, to what extent is her actus reus for disposal. Objective intent: not their mental state etc. but whether the actus reus was proven and who bares the burden in the defense. If it is a strict liability offence what is the defense available due diligence offence. Incomplete offences- what liability can there be if we don"t have a completed actus reus and crime. Shooting in toronto where a police officer shot a boy 9 times who had a knife. Ex: when you try to kill someone and you miss- attempted murder: not guilty of second degree murder but of attempted murder. The second round of shots was not acceptable. The other 6 shots didn"t kill him, so that was attempt murder because he was already going to die.
