The spouses have lived separate and apart for at least one year: no need to prove any misconduct on the part of their spouse. Proving a fault on the part of your spouse: example: adultery. The spouse with whom the divorce is being taken against has treated the other spouse with physical or mental cruelty. No one can block a divorce (so your spouse cannot refuse to divorce you) because all you need to show is the first one (live separate for at least a year) Permanent resident same thing as landed immigrant. A pr must be in canada for at least 730 days in the past 5 years to not lose their pr status, and they can also lose their status if they commit certain acts.
