Importance of the courts: there is no doubt that the scc has had an incredible influence on policy, but it is sometimes exaggerated, the courts have emerged has a significant check. Were always a check, but due to the charter, became a much more profound check on public policies. Dawn of a new era : schultz: emergence of charter and courts as significant check benefitted democracy and did not undermine it as critics would say, significance of the courts is often overstated by the critics. The idea that the charter caused a revolution ignores the role of the scc before the charter. It distorts history to say that there was a radical transformation. The courts poli 221: courts have always been an arena for the political process as well as a significant actor of the political process, umpire of federalism : judicial role in interpretation of division of powers.
