Document Summary

What the anti federalists feared has largely come true. Federal government has taken on responsibilities that traditionally were the province of state governments. Most laws today made from complex interactions between state and nation. Since the adoption of the constitution the single most persistent source of conflict has been the relations between the national and state governments. Founders felt that federalism was a way to protect personal liberties. Hamiltonian vs jeffersonian thought: hamiltonian though the government should have more power, Necessary and proper clause used to expand powers of the national government like in mculloch v maryland. Mculloch won and so did the federal government. Nullification states used to be able to nullify national laws they deemed unconstitutional, this power was revoked with the civil war. Dual federalism states supreme in their spheres while federal government is supreme in other sphere: no longer the case since the two cant be kept separate like in cases of intrastate commerce.
