Legal capacity is the biggest constraint countries face. Signs of learning: brazil has filed more wto complaints than countries with twice its income. Fear of counter-retaliation (like in antigua and ip rights case) Bang-for-the-buck thinking - if a developing country files, it makes it count and goes after big members. Political sensitivity - no one is challenging eu common agricultural policy because it"s so big, it might jeopardize the entire trade regime. Risks preference revelation - you don"t want to reveal your preferences since they will change the behaviour of the other party. Complainant can choose to invite other countries into the room (third parties) or keep consultations private. Those that are most represented: australia, nz, switzerland, canada iii. iv. v. vi. vii. Panel has 6 months for an interim report and then a final (private) report. Experience matters in terms of panel chairs - less experience means greater likelihood of the appellate body overturning the decision.
