It was not until boaz that people looked at relations in north america and south america. So the early work of this was not in north america. Social contracts whether it is common law or same gender etc. they enter into agreements and it becomes a diff. status and you go from oen state of beign to another. They were trying to look at them and find universal ideas of what is going on. Henry maine looked at it as one status to another status contract. Marriage is not the only alliance but in every culture there is some type of partnership where they make a family unit. But kinship is about birth and nurturance and making offspring.
