First amendment was and still is very unique, other countries are more sensitive than. Usa: germany & france are not as liberal - largely due to experiences w/ nazism and hat speech, in feudalist systems (like in europe) nobles used to ght & kill each other b/c of defamation. Free expression: purposes/ theories: required for self- gov"t/ important to democracy. Freedom of speech is needed for democratic purposes so people have all they need to vote . government cannot repress criticism from the public: safety valve. If people are allowed to complain, they can blow off steam and criticize the gov"tso maybe they wont act out violently: individual self-ful lment. Idea that we need freedom of speech in order to encourage truth. What is freedom of the press: freedom of the press has been equated with an absence of prior restraint, so what is prior restraint it is prior censorship.
