Discusses the moral purpose of the law. Legal moralism: the view that the law of a community ought to accord with the predominant moral attitudes of the community. One of the functions of law is to uphold the common moral standard- can justify the infringements of some liberties. Believed the wolfenden report had erred in recommending the legalization of same sex relationships. Against the philosophical basis of this report. Against the legalization of homosexuality as the law is supposed to deter the promulgation of immoral actions. Does not allow victims to give consent when pressing charges in england or canada. Law does not only entail the individual, includes society as well. Premise: any deviation to shared morality is a threat to society. Believed that unchecked passions and private interests are of the state"s concern when they contradict the moral norms of society. The job of the criminal law is to protect the citizens of a society.
