One cannot understand the canadian political context without an appreciation of the judiciary arm. First thing a constitution does is: determine what powers the house of commons has, the senate has, and how these institution(s) relate to one another. It also establishes different levels of power one/ one group has. It also establishes the relationship between citizens and the state. The constitution both allocates political power, it is not a single document, it is actually made up of a number of different components, some written and some unwritten: the constitution act, 1867 (formerly british north america act, 1867) It establishes many of the foundations of the canadian state (house of commons, the senate, many basic state features are laid out in this document) However it is silent or incomplete on others, including the fact that it doesn"t contain an expressed or explicit description on how to be amended.
