3RF3 Charter of Rights and Freedoms
3-2!
-Freedom of Religion Cont’d!
•Scope of the right!
-R v. Big M Drug Mart (1985)!
•Entertain such beliefs as a person chooses!
•Declare such beliefs openly and without fear of hindrance or reprisal !
•Manifest such beliefs by worship and practice by teaching!
•It was criminal in Canada to be open on Sundays, prohibit businesses from
operating!
-Necessary to recognize a common day of faith!
-Offends the religious freedom of religions who observe on a different day,
and atheists!
-Big M challenges this and the supreme court agreed, compels people to
observe a religious day of faith, and it doesn’t distinguish !
-They didn’t enunciate a test because it was so obvious !
-The purpose of this law is to force everyone in Canada to abide by a
particular faith group’s common day of faith, this was intentional to infringe
upon the freedom of religion of Canadians, where law intends to infringe, it
looses full stop, no test, reasonable limits or anything.!
-Loyola High School v. Quebec (2015)!
•2008+ has required schools to offer a religious & ethics course, global based!
•Secular, force all schools to teach all major religions so that the state isn’t
viewed as taking a preference!
-they have to teach it from a secular perspective, made a curriculum and
instruments to help teachers !
