Happens if and when an accused is found guilty of actus/mens rea. After the parole report has been submitted and the judge takes all things into account. The state can say to all of us that this is a bad thing/conduct unacceptable in a free and democratic society: deterrence: The o ender speci cally and the community in general: separation of o ender: They are su ciently dangerous, or it is necessary for them to understand the implication of their actions in order to be incarcerated: rehabilitation: Mandatory counselling, no alcohol, possible incarceration, etc: reparations: You have done something against the community and therefore: promote responsibility and acknowledge harm: If an o ender on the rst time does not plead guilty, they will rarely get an absolute discharge because they haven"t acknowledged their guilt. Must take into account all of the above. There is no sentence, no criminal record, etc: conditional discharge, suspended sentence.
