Enormous changes in family behaviours, values and law marriage and family are evolving institution: broad range conceptions of both marriage and the family re ected in family law. Family law lags behind changing values and behaviours: those dissatis ed will advocate further change. Family laws often not followed: dif cult to enforced. Historical christian (bible) view of marriage: monogamy and no divorce. De ned in 1866 case of hyde and hyde: voluntary union for life of one man and one woman to be excluded above all others, patriarchal. No recognition of the rights of married women. Evolution of values and behaviours - began evolving as society did: starting about 1850 recognition of divorce, slow moves to gender equality in law. Rights to women on separation: many reforms occurred in latter part of the 20th century.
