Royal proclamaion of 1763: declaraion regarding surrendered land from france to england, designated all unsetled land as reserved for indians, under the protecion of the crown, key to future court ruling on land claim right of first naions. Treaty period: coninued unil early 20th century, agreements for paricular rights and provisions from the gov"t in lieu of land being ceded. Consituional provisions: 91 (24): gives responsibility of indian afairs to federal gov"t, ambiguity in regards to unceded land and resource development. Indian act, 1876: imposes band council system, sets out who is an indian and eligible for rights associated, created indian agents, who acted as administrator over the resrve, reaching deep into daily aciviies. Reserve system: territories set assigned under treaies, original highly controlled by assigned indian agent, since 1970"s delegated control to the band council, crown property, cannot be seized, nor can it be leveraged.
