Justice process belongs to the community not the state. Ideal characteristics: positive alternative to the mainstream justice system that includes mediation, cooperation, and support instead of confrontation, blame and punishment, replace isolation with reintegration. Offender must plead guilty and agree to circle sentencing. The sentence will be done by the judge alone at their individual discretion. The offender, victim, family members, other community members and probation officer will also be there. Back then the circle could proceed without victim but now this is not allowed. Community is represented in the circle and the sentence involves an apology, restitution, service work even for the victims family, and counselling. The judge will make the final decision about accepting the sentence laid out. Chiste: the circle can be harder for the offender than the impersonal courtroom. Victim, offender and one support person from each along with a trained facilitator. Offender must plead guilty and agree to fgc, and the victim must also approve.
