Spousal support is granted if proven that the dependent partner is in need for (& sometimes an expectation of) support from her ex-partner & that this need arose as a result of the union. Both the divorce act & family law act provide child support orders: child support. The divorce act stipulates that parents are required to support children of the marriage (biological children, adopted children, stepchildren considered loco parents & other non- biological children ( illegitimate children ) Requires parents to pay support until a child is 16 years or older if the child is incapable of supporting him/herself. Involved payment by one parent to another but is something that is owed by a parent to a child, not by a parent to a parent. The right of the child & therefore children can bring parents to court to obtain it. Court looks for stability, historical caregiving patterns, preservation of relationships, emotional ties & child preferences.
