Litigation is the system of resolving disputes in court. The crown cannot be sued without its consent. They must demonstrate a workable plan for fairly representing the interests of the class members. The ruling must benefit the class members equally: notification: a representative plaintiff must also have a workable plan for notifying potential class members. Notices are very important and includes every member who has not expressly opted out. People who have not opted out cannot bring separate actions on their own: preferable procedure: the court must be convinced that a class action is the preferable procedure for dealing with the claims. Enough similarities between class members, compensation etc. : certification: assuming that the previous requirements the action will be certified. It represents the courts decision to allow the various claims to be joined together and to proceed as a class action.
