Chapter 2 litigation and alternative dispute resolution. Litigation: is the system of resolving disputes in court. As a matter of law, a corporation is a type of person that can be sued or sue. Unincorporated organizations are not classified as legal persons therefore they cannot be sued or sue. Allows a single person, or a small group of people, to sue on behalf of a larger group of claimants. They allow small individuals to take on large organizations. The threat of a class action may prevent a wrong from occurring in the first place. Lawyers provide competent help and increased success. Law societies also require every lawyer to hold professional liability insurance. Allows you to receive compensation from lawyers insurance company. Law societies also create assurance funds to provide compensation to people who have been hurt by dishonest lawyers.
