LAW 122 Lecture Notes - Lecture 16: Film Studio, Clean Hands, Liquidated Damages
Document Summary
Damages is in award of money that is intended to cure a wrongful event, such as a breach of contract. The nature of the remedy needs to be stressed. Except in rare cases, the plaintiff isn"t entitled to receive the exact thing that they expected to get under the agreement. They are entitled to only the monetary value of that thing: ex. I agree to sell you my car but later break that promise after you have paid the price, you are probably not entitled to get the car itself. Instead, you are entitled to the monetary value of that car. Forward-looking damages allow the plaintiff to recover the value of something that they never previously enjoyed but merely expected to receive under contract with the defendant. Expectation damages= expected benefits under contract costs under contract: the expectation value is calculated at that time.
