By forcing wrongdoers to bear the cost of illegal or harmful aciviies, class acions encourage increased compliance with the law. Class acions are oten expensive to undertake and provide very litle compensaion to individual class members while generaing relaively large fees for lawyers. It is said that the prospect of large fee awards creates perverse incenives for lawyers to bring unmeritorious acions. The prospect of large and unpredictable jury awards and the availability of puniive damages create strong pressures on defendants to setle an acion regardless of the merits of the acion.
