What are your issues people immediately formed positions. Impasse, bad press, litigation, distrust: second attempt. Mediation characteristics: neutral facilitator, explores interests, develop options, voluntary settlement. Best used when: parties have tried, cost/speed are key, motivated parties, misunderstanding abound, some issues out of scope for hearing. Issues at law/values: highly-publicized dispute, no motive to settle. Involves parties trying to reach agreement on some or all of the issues in dispute.
