Document Summary
Lecture 3- municipal planning & land use restrictions. Planning authority: planning attempts to bring the orderly development of land through a structured process. Responsibilities set out in the municipal act, 2001. Development charges: municipalities may apply development charges in ways that best suit their local growth related needs and priorities. 37: section 37 (density bonusing) allows local municipal councils to authorize increases in the height and density of development beyond the limits set out in their zoning by law. Parkland contribution: municipalities have the authority to require that developer give a portion of the development land to a municipality for a park or other recreational purpose. Instead of giving over the land, the municipality may require the developer to pay an amount of money equal to the value of the land that would have otherwise been given. Planning in ontario: most responsibilities are at the municipal level, the province sets out provincial interests that the municipalities must respect.
