Document Summary

Chapter 5: canada"s courts: the processes of dispute resolution. Both restorative justice and alternative dispute resolution share a common interest in moving outside of an adversarial content, increasing access to justice and resolving disputes in a manner that builds relationships, avoids conflicts and promotes reconciliation. Our criminal courts, our superior courts, and our courts of appeal each have different jurisdictions. First decision making bodies that an individual will encounter are either the provincial courts, military courts, provincial administrative tribunals, or federal/administrative tribunal. One can then appeal to higher courts to either superior courts of province or the federal court, trial division. Then from there to provincial and federal courts of appeal. Criminal division of provincial courts hears summary conviction offences and offences under provincial statutes. Indictable offences: crimes in the criminal code that are considered to be very serious and that carry substantial penalties: typically, have more serious consequences than summary offences.
