Except for murder, treason, and a few others, the accused may elect trial by judge alone in provincial court or in superior court. In the case of murder, treason and a few others, the case must be heard by a jury unless the defense and the crown agree to a judge alone trial. Canadian criminal juries return a verdict and may make nonbinding recommendaion on sentencing only if a youth is convicted of 1st or second degree murder and an adult is convicted of 2nd degree murder. Jury size: 12 persons and at least 10 must deliberate to return a unanimous verdict.
