Requires that first a substance has been criminalized. It"s no longer important to view the issue as a matter that needs to be addressed by the criminal code. Doesn"t mean there isn"t any legislation (provincial health laws) Ex. may only decriminalize possession, but can keep production criminal. Have decriminalized communication for sex work, but the other stuff is still criminal. Legalization: government control into how things are sold, what types and where they are sold. Ex. marijuana would need to be sold through something like a liquor store. Escort system is legalized, need a licence, get training and are on a database. Create records of who can have it and when/where/why. Big profit for those who run the underground economies-> entrenches gangs and drug entrepreneurs in the market. Criminalization of women who use substances while pregnant (in the us especially)
