Refusing to pay, due to unsatisfied service or unability to pay. Not able to deliver on a contracted order due to equipment malfunction. Each side can agree on an outcome it can live with where as litigaation sides with only one party. May be used to resolve any type os disputes. Can happen any time during the disputer, even the eve or midway through trial. Most often done by the parties of the dispute, but can involve lawyers. Not governed by technical rules and can proceed however the parties see fit. With negotiation the goal is to reach a resolution that is agreeable to all parties. The willingness of the parties to compromise and negotiate in good faith. The priority the parties give to its resolution. The efectiveness of those involved in the negotiations mediation is : Less expensive and quicker than formal dispute resolution methods. Can result un a resolution tailored to the needs of both parties.
