Legal capacity- a person can be found incapable of signing a contract. If you are not legally capable, you cannot be involved in a binding contract: ex. penitentiary, people who are in these places as they are declared unfit for trial. Paul bernardo- was fit for trial but had sexual deviations, his actions don"t constitute as being declared unfit for trial. Age majority- a minor can sign a contract but because they are a minor they may claim hardships. If not for necessities of life, they are not bound to pay: ex. minor purchases ski equipment, cannot afford. Since it is not a necessity for life, the minor can return the equipment in its current condition and is able to walk away: don"t sign a contract with a minor without an adult who can co-sign. Before tower was built there was a small restaurant in its place, pressured the individuals to sell.
