(whether religious, political, or merely commercial) Erwin toy test: a specific criteria for what constitutes freedom of expression (here are criteria:) Ex: pornography constitutes a mere physical activity & doesn"t attempt to convey meaning. Ford & devine both had challenges with 2b.
